Re: NYSDEC Appl. No. 2-6202-00073/00001-0
Use of Alken Clear-Flo® formulation - in Central Park
New York City, waterbodies - to reduce ammonia
& control algae

Dear Mr. Bergman:

After careful consideration of the additional information provided in John Luce's (Alken-Murray Corp.) technical justification for the procedure, it has been determined that no permit is required from the New York State Department of Environmental Conservation for the use of the Alken Clear-Flo® formulations in Central Park waterbodies.

As you are aware, this is the first time that the formulations would be applied to treat waterbodiesin the New York City area. We apologize for any inconvenience the delay may have caused. While this department does not endorse the use of the formulations at this time, we would appreciate a copy of monitoring results.

If you have any questions, please contact Kenneth Smith at the above address or call (718) 482-4997.

Very truly yours,
